The Story of Marijuana in Beverly Hills
Cannabis has a long and interesting history in Beverly Hills. It arrived as hemp with the Spanish in the late 19th century. During the 20th century, people started cultivating sativa throughout the state. With the arrival of Mexicans later, it adopted the name “marijuana.” Unfortunately, as people’s health deteriorated because of other narcotics, prohibition began and it did not exempt weed.
States began introducing laws to ban cannabis. Despite popular belief, the Marijuana Tax Act of 1937 was not the first weed restriction. It actually began in 1907 with the Poison Law, which went through amendment in 1913. The Marijuana Tax Act only came into being because the Poison Law and its amendments did not achieve the intended purpose of restricting pot possession.
Then came widespread anti-narcotics campaigns, led by the California Board of Pharmacy. That was a long time ago, however, and since then, legalization became popular. The state had to evolve its stance on prohibition and listen to public outcry. In the end, Beverly Hills and other California cities became pioneers in leading the legalization revolution across the country.
The enthusiasm to legalize marijuana did not reach the federal government, though. Marijuana is still a Schedule 1 drug under the Controlled Substances Act, and as such, officials may arrest people caught with it on federal property. Fortunately, states have the power to make their own cannabis laws. After several propositions over the last decade, California allows people to grow, carry, use and sell weed.
Back in 1996, it became legal to have marijuana for medical reasons under Proposition 215. With a doctor’s recommendation, patients could grow, purchase and use cannabis to treat their illnesses. This ordinance banned marijuana cultivation throughout Beverly Hills – for everyone, including every marijuana delivery service – citing safety concerns, such as robbery, theft, fire, and cannabis fumes, and arguing that a marijuana dispensary in Beverly Hills was not part of the city’s industrial plans.
Just when all hope was lost, voters approved Proposition 64, forcing California and its cities to lift marijuana restrictions. The city is now drafting bills to force taxation, regulation and licensing compliance.
