Several regulatory ordinances have gone through the City Council of Culver City. One of them is Chapter 9.11 of the Municipal Code, which protects people from secondhand smoke by prohibiting smoking in multi-unit housing. With other Los Angeles cities, Culver City was waiting for the 2016 general election to determine how to enforce marijuana laws, as Proposition 215 made regulation a challenge.
Under Proposition 215, it is legal to cultivate and transport marijuana. However, there are still far too many cases entering the justice system. Uncertainties abound and there is much confusion surrounding the use of weed. Proposition 64 instigated significant marijuana reform and it is slowly eliminating this type of insecurity by forcing city councils to adapt its provisions.
Under the city’s zoning codes, Culver City may not establish marijuana facilities in its jurisdiction. Now, with Proposition 64 enacted, it will have to hold public discussions to establish the next step for general marijuana use. The City Council must amend its Municipal Code to adopt the provisions contained in Proposition 64. The “No Grow” degree may well change in the near future.
Cultivation has been a legal grey area for many years. Current zoning rules do not clarify whether people may grow in unincorporated areas, and while a temporary ban is effective for 45 days, federal law allows counties to extend this to two years. Culver City must examine the impact of cultivation, testing, processing, and distribution on the environment and the community.
