Most of these claims are obsolete. Marijuana dispensaries have been proven to lower crime and the fact that it is illegal at the Federal level does not make it illegal at the State level. The claim that it will lower the character of a community is completely subjective, and there may be some basis to the dangers of having a dispensary close to a school. But all these points notwithstanding, if the community do not want a dispensary it really is their choice.
There was a signed lease in place. The property’s owner, Greti Croft, said she told the potential dispensary owners (Wellness Center) that she would lease the office space to them unless her other tenants objected. They did, and she has since cancelled the lease and returned the first and last month’s rent and deposit.
Despite the objections, Planning Commission staffers recommended the commission deny the appeal.According to a spokesperson: “They met all of our ordinance requirements, all the Comprehensive Plan and the Orcutt Community Plan policies…We don’t have an ordinance to prohibit it.” There are said to be other complications at this time with regard to dispensary laws in the county, which raised the minimum aged requirements for dispensary clients from 18 to 30. However, until the leasing issue gets resolved these other complications take secondary priority. According to Croft, a natural healer, marijuana is all well and good but has no place in Orcutt, and if the tenants do not want one then that is enough. But it does seem at this point that Wellness Center have met all of the requirements and the Planning Commission might not have grounds to refuse the dispensary.
