Marijuana in Shingletown
Shingle town is a small Census Designated Place (CDP) in Shasta county, with a population that is estimated to be under 3,000. It follows the rules of Shasta County with regard to marijuana related activity. Shasta County is not the most marijuana friendly of places, and since the enactment of The Cannabis Regulation & Safety Act (“MCRSA”) in 2015, Shasta’s Board of Supervisors have enacted further restrictions on cannabis activities within the unincorporated areas of the county (Shingletown is not incorporated). This is mainly because, historically speaking, Shasta County has seen a lot of illicit marijuana action which caused harm to society and is a constant headache to law enforcement officials.
As of 2016, Ordinance SCC 2016-01 changed the County Code of Shasta County by adding Section 17.88.315. The latest regulations, which apply only to the unincorporated areas of the county, prohibit the delivery or transfer by any dispensary of Cannabis or Cannabis products to a qualified patient or primary caregiver. Newly amended Section 17.88.320 requires a qualified patient or primary caregiver to obtain a zoning permit before cultivation can occur on the premises.
Ordinance SCC 2014-02 amended the Shasta County Zoning Plan relating to Cannabis cultivation and residential accessory buildings. The Ordinance, which was adopted by the Board of Supervisors on January 2014 and approved by the voters on November 4, 2014, applies to all properties in the unincorporated area of Shasta County as of November 5, 2014 – meaning that property located in one of the incorporated municipalities within the county, such as Redding, Shingletown or Shasta Lake, is instead governed by that particular city’s regulations.
As per the rules of the Ordinance, medical patients may not cultivate more than 12 plants per residence, regardless of how many patients are in the residence and the size of the dwelling. This is not altogether harsh. 12 is a large number of plants and should be more than enough to accommodate a patient if not two or three. There is also a lot of leniency is the sense that some plants have huge yields with denser and larger buds than others.
Cultivation is permitted only within a legally-established detached residential accessory building that is located on any piece of land with a primary residence occupied by the cultivating qualified patient (or else a primary caregiver to a marijuana patient) Outdoor cultivation and cultivation within a residence are strictly prohibited. Outdoor cultivation is something that all county boards have to consider. Many contend that outdoor growing is more trouble than it is worth, with security and odor concerns. There are a number of zoning regulations that need to be in place so that users can grow marijuana outdoors. However, growers argue that in many cases it is easier to grow outdoors than indoors, as there are significant space and electricity requirements to successfully grow plants indoors. Shasta’s lawmakers have also banned Cannabis dispensaries within the unincorporated areas of the County.
While some of the rules in Shasta County and Shingletown might seem harsh, Shingletown in particular has been home to numerous illegal growing operations over the years. These illegal growing operations are toxic to the environment and usually provide poor quality weed that is high in toxins. These illegal growing operations are mainly run by Mexican drug cartels according to authorities.
Until this situation gets under control, it is far better to ban a large number of activities and leave the distribution of marijuana to regulated and licensed marijuana delivery services. Shasta County is top of the marijuana illegal growing list in California, an area that is itself currently seeing a lot of illegal growing activity. But this is expected to go down as marijuana gets legalized and regulated, becoming commonly accessible by all without having to pay for black market marijuana that can be actively harmful to patients.
